Resolved Question: Please Help! A friend past a way he got on an accident on a storm drain access above ground. Is city at fault?

Their is a two way road in San Diego, Escondido , CA and their is a storm drain access that is about knee height it is a round structure that looks like its bomb proof don’t think it's necessary. The roads turns to the right but if you miss the turn you would run right into the storm drain. R.I.P my friend past a way he hit the storm drain at 40mph around the speed limit. My question is if the storm drain had a guard rail or was flush with the ground he would have survived. Is their anything the family can do to get that storm drain access removed and made flush? It is like a human trap if you miss the 30 degree turn and continue straight you are destined to hit and come to a complete stop instantly.
